Defective Medication

Manufacturers of drugs, medications, and medical devices are obliged to provide products that are reasonably safe when used as intended. Even if a product is approved by the FDA, it does not dispense the manufacturer from liability. Companies have a duty to inform the public of a product's possible risks, e.g. for non-prescription drugs by proper labeling and enclosures. In the case with prescription drugs, the manufacturing company only has a duty to inform the physician, for they are used under the supervision of a physician.
